JapanETCcard Terms and Conditions for ETC Card

TERMS OF USE AGREEMENT

This Terms of Use Agreement (the "Agreement") governs your access to and use of the JapanETCcard.com website (the "Website") and the electronic toll collection card services (the "Service") provided by JapanETCcard. By using the Website or Services, you agree to adhere to the terms of this Agreement and to comply with all applicable laws and regulations under Japanese law and NEXCO standards.


MODIFICATIONS TO TERMS

JapanETCcard reserves the right to amend, revise, or update these terms at its sole discretion. Any changes will become effective immediately upon being posted on the Website. Your continued use of the Website or Services after the posting of modifications constitutes your acceptance of the revised terms.


ARTICLE 1: DEFINITIONS OF TERMS

  1. Unspecified Terms: Terms not explicitly defined in this Agreement shall carry the same meaning as provided in the applicable Terms and Conditions ("T&C").
  2. Road Administrator: Refers to the designated authority responsible for toll road administration as per the Road Maintenance Special Measures Law.
  3. ETC System: Refers to the electronic toll collection system enabling Card Members to pay tolls and other associated fees at designated toll gates using the ETC Card, onboard equipment, and the Road Administrator's toll gate infrastructure.
  4. ETC Card: Refers to the card issued to facilitate toll and fee payments within the ETC System as managed by the Road Administrator.

ARTICLE 2: ISSUANCE AND RESPONSIBLE USE OF THE ETC CARD

  1. Card Issuance:
    Applicants who agree to the T&C and this Agreement, and are accepted as members of JapanETCcard ("Card Members"), will be issued an ETC Card.

  2. Ownership:
    The ETC Card remains the property of JapanETCcard. Card Members are required to manage and use the card responsibly, ensuring its safekeeping and maintenance.

  3. Restricted Use:
    The ETC Card is for the sole use of the registered Card Member. It must not be lent, transferred, or used as collateral. It may not be provided to third parties under any circumstances.


ARTICLE 3: USE OF THE ETC CARD

  1. Operational Use:
    Card Members must insert the ETC Card into designated onboard equipment during use. The card must be removed and stored securely when the vehicle is unattended.

  2. Applicable Policies:
    The use of the ETC Card and ETC System is subject to the terms of this Agreement, the T&C, and the policies set forth by the Road Administrator.

  3. Vehicle Registration:
    The ETC Card is intended for use with the registered primary vehicle. Use in other vehicles is permissible but remains the responsibility of the Card Member to ensure compliance with NEXCO standards.

  4. Vehicle Updates:
    Card Members must update their vehicle information via the JapanETCcard.com Website when changing their primary vehicle to maintain compliance with the Japanese highway network.


ARTICLE 4: VALIDITY AND FEES

  1. Card Validity:
    The validity period of the ETC Card is printed on the card.

  2. Service Fees:
    Card Members are required to pay applicable fees for the ETC Card and associated services. Fees are billed monthly based on toll usage.

  3. Non-Refundable Fees:
    Fees are non-refundable, even in the event of membership cancellation or termination.

  4. Fee Review:
    Members should periodically review the updated fee structure. Dissatisfied members may contact JapanETCcard for assistance with resolution or membership cancellation.


ARTICLE 5: SCOPE OF USE

  1. Primary Use:
    The ETC Card is intended for toll payments via the ETC System in compliance with the Road Administrator's terms.

  2. Secondary Services:
    Use of the ETC Card for services beyond toll payments is subject to the terms of the respective service providers.


ARTICLE 6: PAYMENT OF TOLLS

  1. Payment Method:
    Toll charges will be automatically settled through the credit card designated by the Card Member.

  2. Dispute Resolution:
    Disputes concerning toll charges must be resolved directly with the Road Administrator. JapanETCcard assumes no liability for such disputes.

  3. Administrative Fee:
    If a dispute over a charge is found to be fraudulent or baseless, the Card Member will incur a fee of ¥2,500 to cover administrative and third-party processing costs.


ARTICLE 7: LOSS OR THEFT OF THE ETC CARD

  1. Reporting Requirements:
    Lost or stolen ETC Cards must be reported immediately to both JapanETCcard and the Road Administrator.

  2. Liability for Misuse:
    Card Members remain liable for charges incurred from misuse of a lost or stolen card unless explicitly stated otherwise.

  3. Third-Party Misuse:
    JapanETCcard is not liable for unauthorized use of lost or stolen cards by third parties.

  4. Negligence:
    Card Members bear full liability for charges resulting from gross negligence, such as leaving the ETC Card in onboard equipment.


ARTICLE 8: REISSUANCE OF THE ETC CARD

  1. Eligibility for Reissuance:
    Reissuance of an ETC Card is at the discretion of JapanETCcard. Applicable fees may be charged.

  2. Procedures for Reissuance:
    Members must comply with required procedures and update their details with the Road Administrator if the card number changes.


ARTICLE 9: MEMBERSHIP CANCELLATION

  1. Cancellation Process:
    Card Members wishing to cancel must submit the prescribed cancellation form and either return or destroy the ETC Card as instructed.

  2. Final Settlement:
    Membership cancellation is complete only after the settlement of all outstanding charges. Returned cards must be rendered unusable by cutting the chip or following provided instructions.


ARTICLE 10: SUSPENSION OR TERMINATION

  1. Grounds for Suspension:
    JapanETCcard reserves the right to suspend or terminate ETC Card services in cases of violation of this Agreement or related terms.

  2. Card Return:
    Suspended or terminated cards must be returned to JapanETCcard immediately.


ARTICLE 11: LIMITATION OF LIABILITY

  1. Third-Party Disputes:
    JapanETCcard assumes no responsibility for disputes or damages arising from road accidents, onboard equipment malfunctions, or other third-party issues.

  2. Card Malfunctions:
    JapanETCcard is not liable for losses resulting from card malfunctions or operational errors caused by the Card Member.


ARTICLE 12: GOVERNING LAW

This Agreement is governed by and construed in accordance with Japanese law. Matters not explicitly addressed herein shall adhere to the T&C and NEXCO policies.
